EU Cookie Law – our current advice

Have you updated your site to comply with the new “Cookie Law”? Does the law make any sense to you? Are you just as confused as 99% of people out there about it?
What is even more confusing is that the ICO changed their minds to allow implied consent at the last minute

 

 So do I need a warning and a policy, or something more?

The ICO with that last minute change has caused a load of confusion.

  • If someone has cookies enabled in their browser, does that imply consent?
  • Does the simple act of visiting your website imply consent?
The safest thing is to make sure you outline the cookies you use either within your privacy policy, or on a separate “Cookie Usage” page, and add a link to it somewhere on your homepage.

Even though the ICO have already said they’re unlikely to prosecute anyone, they’d have a much harder time doing so now as their 11th hour change has made everything so much more ambiguous than before.
